En boletín oficial, La Procuraduría Federal de Protección al Ambiente (PROFEPA), informó la sanción a BMW de México.
En el mes de septiembre del 2016, Honda de México era también sancionada por PROFEPA:
Comunicado:
«La PROFEPA sancionó con $1,847,617.75 a BMW DE MÉXICO, S. A. de C.V., por importar y comercializar 816 motocicletas sin haber obtenido de manera previa once Certificados NOM de Cumplimiento Ambiental correspondiente a la NOM-082-SEMARNAT-1994.
+La multa generada por la falta de autorización fue por importar y comercializar motocicletas en el año 2015 sin once Certificados NOM de cumplimiento ambiental.
La Procuraduría Federal de Protección al Ambiente (PROFEPA) sancionó con $1,847,617.75 a BMW DE MÉXICO, S. A. de C.V., por importar y comercializar 816 motocicletas sin haber obtenido de manera previa once Certificados NOM de Cumplimiento Ambiental correspondiente a la NOM-082-SEMARNAT-1994.
La multa se notificó este 23 de mayo de 2017 de conformidad con la Ley General del Equilibrio Ecológico y Protección al Ambiente.
Las motocicletas involucradas abarcan los modelos C 600 SPORT, C 650 GT, F 700 GS, F 800 R, F 800 GS, F 800 GT, F800 GS ADVENTURE, G 650 GS, K 1300 R, K 1300 S, K 1600 GTL, K 1600 GTL EXCLUSIVE, R NINET, R 1200 RS, R 1200 R, R 1200 RT, R 1200 GS ADVENTURE, R 1200 GS, S 1000 R y S 1000 RR, año modelo 2015 y 2016.
Durante la visita de inspección practicada el 21 de septiembre de 2016 por los inspectores de la PROFEPA, BMW DE MÉXICO, S. A. de C.V., no acreditó haber obtenido 11 Certificados NOM de Cumplimiento Ambiental de manera previa a la importación de las motocicletas.
Cabe mencionar que con base en la Norma Oficial Mexicana NOM-082-SEMARNAT-1994, la empresa debió acreditar los límites máximos permisibles de emisión de ruido de las 816 motocicletas antes de su importación y comercialización en el territorio nacional.
Con estas acciones la PROFEPA vigila que toda la industria automotriz que importa y comercializa vehículos nuevos en México cumpla con la normatividad ambiental, y de ser necesario la sancionará de acuerdo a la Ley General del Equilibrio Ecológico y la Protección al Ambiente».
